Terms & Conditions
These Terms and Conditions ("Terms and Conditions") govern the relationship between Boundless Magic Travel, LLC ("BMT," "we," "us," or "our") and you, the purchaser and/or traveler ("Client," "passenger," "you," or "your"). By planning travel with BMT, you agree to be bound by these terms and acknowledge that BMT acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other travel services ("Supplier(s)"). BMT is not the source or provider of the travel services. These terms include warranties, disclaimers, and exclusions of liability and may restrict your rights and remedies while providing protections to BMT.
1. USE OF BOUNDLESS MAGIC TRAVEL SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with BMT. You agree to be financially responsible for all travel bookings made on behalf of yourself and any member of your traveling party. You warrant that all information supplied by you on behalf of yourself, your household, or others for whom you are authorized to transact business with us is true and accurate. You agree to only make legitimate reservations or purchases with BMT and its Suppliers and acknowledge that speculative, false, or fraudulent reservations are strictly prohibited.
All bookings are accepted by BMT as an agent for the travel Suppliers listed in your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services. You understand and agree to abide by the terms and conditions imposed by any Supplier selected as a service provider for an itinerary you have approved.
2. PAYMENTS AND CANCELLATIONS
You are responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings through BMT. By submitting a credit card authorization form to BMT, you agree to allow us to use your payment method to purchase travel products from our Suppliers on your behalf.
Payment Discrepancies: If you believe there is an error in any payment processed by BMT, you must notify us immediately and no later than seven (7) calendar days from the date of the charge. Failure to notify BMT within this timeframe may waive your right to dispute the charge and could result in forfeiture of any recourse related to the payment.
Third-Party Payments: If the name on the credit card used for payment does not match the name of the traveler, you must notify BMT before processing the payment. We reserve the right to verify the payment with the cardholder before finalizing the transaction. Failure to comply with this requirement may result in a delay or cancellation of your booking.
Chargeback Liability: You agree not to dispute any charge with your bank or credit card company to avoid or violate any booking terms and conditions of BMT or its Suppliers, including cancellations or changes of itinerary or arrangements beyond BMT’s control. If you initiate a chargeback, reversal, or recollection of a previously authorized trip payment, BMT reserves the right to collect all additional costs, fees, and expenses associated with such action, including but not limited to attorney fees.
All payments for travel are due before departure according to each Supplier’s terms and conditions. Failure to make final payment or violating a Supplier’s conditions of purchase may result in cancellation of your reservations, denial of access to flights, tours, hotels, cruises, or forfeiture of any monies paid. Many bookings are non-refundable once confirmed and under deposit. Cancellation requests must be sent in writing to BMT. Cancellation fees, as well as Supplier cancellation penalties, will apply.
3. TRAVEL DOCUMENTS AND IDENTIFICATION REQUIREMENTS
Each traveler is responsible for obtaining and carrying valid passports, visas, and all other documents required by applicable government regulations. Identification requirements for travel can be found at TSA’s website. Failure to comply may result in denied boarding or undue delays, causing missed flights or other travel arrangements.
Travelers should ensure that passports remain valid for at least six (6) months beyond the date of return. Non-U.S. citizens may require additional documentation. BMT is not responsible for denied entry or visa-related issues.
4. HEALTH, IMMUNIZATIONS, AND SAFETY
You must comply with all required immunizations, health screenings, and documentation before travel. BMT does not assume responsibility for verifying health, vaccination, or documentation requirements. Consult the CDC and the State Department for travel health updates.
BMT does not warrant the safety of any destination and urges Clients to review travel warnings, prohibitions, and advisories issued by the U.S. Government before travel. Registering with STEP is recommended for travelers abroad.
5. AIR TRAVEL AND SCHEDULE CHANGES
BMT does not assume responsibility for airline schedule changes or cancellations. Some departure taxes may be payable in cash at departure. Failure to use a reservation may result in automatic cancellation of return flights and forfeiture of airfare.
It is strongly recommended that travelers check in at least 2 hours before domestic flights and 3 hours before international flights. Reconfirm flight times at least 24 hours before domestic flights and 72 hours before international flights.
6. FORCE MAJEURE
BMT is not liable for failures or delays in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, strikes, or pandemics. BMT strongly recommends purchasing travel insurance for unforeseen disruptions.
7. TRAVEL INSURANCE
BMT offers access to travel insurance to protect your investment in travel. Travel insurance is not automatically included in the cost of your itinerary. Without insurance, you understand that cancellations or interruptions may result in the loss of monies up to the full cost of your trip. BMT is not responsible for claims denied by any insurance provider.
8. CLIENT CONDUCT
Travelers are expected to adhere to the behavior guidelines established by BMT and its Suppliers. Disruptive behavior endangering yourself or others, or interfering with travel arrangements, may result in removal from travel arrangements without a refund. Travelers are responsible for damages caused during their trip and may be charged accordingly.
9. LIMITATION OF LIABILITY
BMT acts solely as a booking agent and is not responsible for Supplier actions or omissions. BMT shall not be liable for personal injury, property damage, Supplier bankruptcy, force majeure events, or other circumstances beyond its control.
BMT’s liability is limited to the commissions and fees received for travel transactions. Any disputes arising under these terms will be governed by Texas law.
10. RESERVATION OF RIGHTS
BMT reserves the right to amend these Terms and Conditions at any time. The latest version will be provided to Clients and posted on our website.
By booking travel with Boundless Magic Travel, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
